ATO found guilty in rehearing

2:41 p.m., March 18, 2005--The Alpha Tau Omega (ATO) fraternity at the University of Delaware was found guilty of violating the Student Code of Conduct and will be suspended through the spring semester 2009, pending appeal. The fraternity, which received the decision March 15, has until March 23 to file an appeal.

This is ATO’s second hearing on several alleged violations of the Student Code of Conduct that occurred at a Sept. 12, 2004, party at the fraternity house. The University granted a rehearing of the case in February, after it learned that an e-mail sent by fraternity officers requesting a rescheduled hearing was never received. The fraternity had requested a rescheduled hearing because an adviser would not be able to be present on the scheduled date.

At the rehearing on March 10, the fraternity was charged with two counts of endangering the lives or safety of others and one count of failing to comply with Delaware alcohol regulations and was found guilty of all three charges. The former president of the fraternity served as adviser for the rehearing.

If ATO appeals the ruling, then it will go before the Appellate Board in early April.
