UD publishes 2015 Clery Act report on crime

1:26 p.m., Oct. 1, 2015--Each year, the University of Delaware complies with the federal Crime Awareness and Campus Security Act, more commonly known as the Clery Act, by reporting on the nature, date, time and location of crimes occurring on campus.

In addition, the act prescribes a number of security-related protocols for emergency response procedures, timely notifications for on-campus crimes and missing students, and fire incident reporting.

"UD was randomly audited by the U.S. Department of Education in 2010 with a positive outcome and a reputation for 'doing it right,'" said Yvonne Simpson, UD's Clery compliance officer. "We take Clery compliance very seriously, and we continue to work hard to ensure that our University is in compliance.

"It is important for members of our community to understand that these efforts are part of the University's commitment to the safety and security of our campus community," she said.

In the past two years, the Department of Education has made changes to the information required for the Annual Security Report, and, as a result the forthcoming report for 2015 includes higher numbers in some areas. These changes do not necessarily indicate an increase in crime, but a change in reporting, Simpson said.  

Due to ongoing efforts to train and educate the community regarding safety and the importance of reporting, the number of reports received from members of the UD community designated as Campus Security Authorities has increased, she said.  "The information provided by CSA’s is critical to providing an accurate accounting of incidents happening on and around our campus. We appreciate their efforts as we could not provide our community with the information they need to make decisions regarding their safety without their assistance and cooperation." 

Crime reporting

By Oct. 1 of each year, institutions are required to publish and disseminate an annual crime report providing crime statistics occurring on campus for the current calendar year and two preceding years, and a description of certain security-related policies. Institutions also are required to publish a daily crime log, which is not limited to crimes stipulated by the Clery Act. 

The 2015 report is available at www.udel.edu/police/clery, and all members of the University community will receive an email providing a link to the full report.  

Crimes that must be reported under the Clery Act are criminal homicide, sexual assault (which includes rape, fondling, incest, and statutory rape), robbery, aggravated assault, burglary, motor vehicle theft, arson, liquor, drug or weapon law violations and hate crimes; with the addition in 2013 of domestic violence, dating violence and stalking.

These crimes must be reported if they occur: 

• on campus, which is defined as any building or property owned or controlled by the University within the same reasonably contiguous geographic area; 

• on public property, such as thoroughfares, streets, sidewalks and parking facilities that are within campus or immediately adjacent to and accessible from campus; and 

• any non-campus building or property that is owned or controlled by a student organization officially owned or controlled by UD.

Additional requirements

The Clery Act also requires institutions to communicate a serious crime or emergency to the campus community in a timely way. At UD, these notifications are handled through the UD Alert system

In addition, the University must publish a fire safety report including fire statistics and a description of each fire safety systems; and must have a procedure for gathering missing person contact information for students living in residential facilities.
