UD Officer Michael Brannan, who is a member of the New Castle County Anti-Graffiti Task Force, conducted the investigation that led to the arrest, working with colleagues from the Delaware State Police, CSX Police, the Fire Marshall's Office and the Newport Police Department. A search warrant was executed prior to the arrest, and evidence was seized that led to the arrest. Lepore, who is not a UD student, is also under investigation by other police agencies in connection with graffiti damage.

Lepore has been charged with third degree burglary, felony graffiti and possession of graffiti instruments, and he was committed to the Howard Young Correctional Institution in lieu of $2,250 secured bond.
