Illegal to Occupy Attics or Basements

Dear (Tenant/Owner):

Each year we find that some tenants occupy the third floor/attic or basement areas of rental units. This is a very dangerous practice because a fire could block an exit and cause death or injury.

Such illegal occupancy is also in violation of Newark's Housing and Fire Codes. If the third floor attic or basement areas are found to be occupied without proper exits and approvals, the tenants and/or owner may be prosecuted. A conviction in Alderman's Court for violating Chapter 17, Section 702.3, Number of Exits, could result in a criminal fine and the loss of permission to rent the house.
