Purpose:

The University of Delaware is committed to developing and maintaining an environment that encourages students participating in intercollegiate athletic competition to avoid the abuse of alcohol and the unauthorized use of controlled substances and performance enhancing drugs.

In the interest of the personal health and safety of student-athletes competing in the University of Delaware Intercollegiate Athletic Program , the Division of Intercollegiate Athletics & Recreation Services does not condone and will not ignore drug and substance abuse or illegal use by a student-athlete.  The Division does not endorse or permit the use of performance enhancing substances.  This policy is compatible with drug testing legislation enacted by the NCAA for implementation at its National Championships and year-round testing.

The specific purpose of this drug-testing program is:

1. to deter drug use,

2. to identify athletes whose use of drugs poses a safety hazard to other athletes, recruits, and a health hazard to themselves, and

3. to insure the integrity and competitive fairness of the University of Delaware Intercollegiate Athletics Program .

Policy:

The unauthorized use of anabolic steroids, stimulants, diuretics, performance enhancing drugs, marijuana, cocaine, amphetamines, nicotine, alcohol, and any other substance proscribed by federal or state law, by any member of an intercollegiate athletic team at the University of Delaware is expressly prohibited, regardless of whether such use or abuse occurs before, during or after the team’s competitive season.

Consent & Education of the policy:

A list of banned substances will be provided to every team member during their NCAA eligibility meeting at the beginning of each academic year.  At this time, the Drug Consent form for the University of Delaware Drug Testing program will be administered.  The list of banned substances will be listed in the NCAA manual, in the Student-Athlete Handbook, and can be provided upon request to the student-athlete by his/her coaching staff.  (See Appendix A for the Consent Form and Appendix B for banned substances.)  These policies can be found on-line at:  http://www.udel.edu/ssa/.

The Testing Program:

The University of Delaware ’s Division of Intercollegiate Athletics and Recreation Services has instituted a general program of drug testing by urinalysis for student-athletes engaged in intercollegiate athletics.  The testing program will include random testing throughout the year and/or referral by a committee based on reasonable suspicion.

The testing program shall be administered throughout the year in a random, unannounced pattern.  Each such testing shall, in addition, include all retest candidates as well as any athlete(s) referred for testing by the Head Coach or a faculty member and must be based on reasonable suspicion and approved by the Director of Athletics.

The results of the testing program shall be available only to the testing laboratory and the Athletics Administration.  The results may be made available to University personnel who have a demonstrably legitimate need to review such records.

The Testing Method:

The standard method for testing for drug use shall be through independent laboratory analysis of urine samples provided by student-athletes.  Urine specimens shall be collected in the presence of a same sex, trained observer assigned for that purpose.  Results of the test shall be available only as required for implementing this drug testing policy (as stated above).

Each student-athlete will have the opportunity to declare any “over-the-counter” drugs or prescription drugs used on an appropriate form provided during the sample collection process.  No student-athlete will be penalized by the University of Delaware ’s Division of Intercollegiate Athletics & Recreation Services for the proper use of drugs so declared and confirmed by medical personnel.

The Testing Protocol:

The protocol for testing shall minimize the chances for cheating.  While this makes the testing program personally more invasive, it is necessary to assure the integrity of the program.  A copy of the protocol shall be provided to each student-athlete along with this policy statement (see Appendix C).

Coaches shall not be involved in the urine sample collection process.  Testing of urine samples shall be performed by an independent laboratory qualified to provide such procedures.

Sanctions:

First Positive Result:

A student-athlete whose urine is found to contain banned substances during the course of his/her matriculation at the University of Delaware shall be subject to the following procedures:

1. The student-athlete shall be notified either in writing or in person that his/he urine was found to contain a banned substance and he/she shall be required to meet with the Director of Athletics within 3 calendar days of notification.  If the student-athlete fails to meet with the Director of Athletics within the specified period of time, the student-athlete will be immediately suspended from his/her intercollegiate athletic team.  The student-athlete shall have the right to appeal in accordance with the appellate procedures.

2. The student-athlete shall meet with the Director of Athletics to review the testing procedures and test results.  Upon determination that the procedures are correct and the test results valid, then:

a. The Head Coach will be notified of the results by the Director of Athletics; and

b. The student-athlete shall be immediately suspended from his/her intercollegiate athletic team for at least a minimum of four weeks; and

c. The student-athlete shall participate in an assessment program with a drug & alcohol counselor.

d. If the student-athlete is a minor, the Director of Athletics will provide written notification to the student-athlete’s parents. This letter will include: the results of the drug test, notification of the assessment program, any scholarship consequences, notification that the student-athlete will be retested, and any other conditions to be imposed.

e. The student-athlete shall be permitted to rejoin his/her team (a) upon the successful completion of a drug assessment program and (b) with the approval from the Director of Athletics and the Head Coach.

f. The student-athlete could be retested (3) times within 180 days after the positive drug test. Retests shall be scheduled in consultation with a drug-testing laboratory to assure that all traces of the banned substance identified in a prior test have passed through the student-athlete’s system, and will not be re-detected. Student-athletes can continue to be retested based on the recommendation of the Substance Abuse Counselor.

g. One of the following statements will be used when a positive drug test results in a student-athlete’s suspension from the team or ineligibility for post-season competition: “The student-athlete in question was found in violation of the NCAA eligibility rules and has been declared ineligible for competition (or post-season competition),” or “the student-athlete in question was found in violation of University of Delaware athletic team participation regulations”.

Second Positive Result:

A student-athlete, who after an initial positive drug test, receives a second positive drug test during his/her matriculation, shall be subject to the following:

1. The student-athlete shall be notified either in writing or in person that his/her urine was found to contain a banned substance, for the second time,  and he/she shall be required to meet with the Director of Athletics within 3 calendar days of notification.  If the student-athlete fails to meet with the Director of Athletics within the specified period of time, the student-athlete will be immediately suspended from his/her intercollegiate athletic team.  The student-athlete shall have the right to appeal in accordance with the appellate procedures.

2. The student-athlete shall meet with the Director of Athletics to review the testing procedures and test results.  Upon determination that the procedures are correct and the test results valid, then:

a) The Director of Athletics will notify the Head Coach of the results.

b) The student-athlete will be immediately dismissed from the team for one (1) calendar year, 365 days, from the date of suspension. No practice, competition or any involvement with the team is permitted. (Please note that an assessment and recommendation from the Drug Counselor will be required to be reinstated.)

c) All athletically-related financial aid will cease at the earliest possible date consistent with the NCAA Bylaws and Constitution.

If a student-athlete loses his/her athletically related financial aid as a result of a positive retest, he/she shall be granted the opportunity for a hearing by the appropriate University authority consistent with the procedures set forth by the NCAA Bylaws and Constitution.

d) The student-athlete shall be permitted to rejoin his/her team (a) upon the successful completion of the one-year suspension stated above and (b) with the recommendation of the Drug Counselor, the Director of Athletics and the Head Coach and a negative re-test result.

Third Positive Result:

A student-athlete, who after an initial positive drug test, receives a third positive drug test during his/her matriculation, shall be subject to the following:

1.  The student-athlete shall be notified either in writing or in person that his/her urine was found to contain a banned substance, for a third time, and he/she shall be required to meet with the Director of Athletics within 3 calendar days of notification.  If the student-athlete fails to meet with the Director of Athletics within the specified period of time, the student-athlete will be immediately suspended from his/her intercollegiate athletic team.  The student-athlete shall have the right to appeal in accordance with the appellate procedures.

2.  The student-athlete shall meet with the Director of Athletics to review the testing procedures and test results.  Upon determination that the procedures are correct and the test results valid, then:

a) The Director of Athletics will notify the Head Coach of the results.

b) The student-athlete will be dismissed from his/her intercollegiate athletic team and will be prohibited from representing the University of Delaware in intercollegiate athletic competition for the remainder of his/her matriculation at the University of Delaware .

c) All athletically-related financial aid will cease at the earliest possible date consistent with the NCAA Bylaws and Constitution.

If a student-athlete loses his/her athletically related financial aid as a result of a positive retest, he/she shall be granted the opportunity for a hearing by the appropriate University authority consistent with the procedures set forth by the NCAA Bylaws and Constitution.

Refusal to Provide a Sample/Failure to Keep Appointment:

If a student-athlete refuses to provide a sample during the test process or who fail to keep a scheduled drug test appointment shall be deemed in violation of this policy.  This violation shall be equivalent to a “positive” test result and the appropriate level offense consequences shall be applied.

Withdraw of Consent:

Withdraw of consent to testing shall, regardless of current-year test schedules, preclude participation and renewal of an athletic grant-in-aid for the following year unless and until said consent is reinstated by signing a new consent form.  Withdraw of consent to testing which has the effect of interdicting schedule tests shall be treated as above (refusal to provide a urine sample).

Appeals Process:

1. Ability to retest:

A student-athlete who contests a laboratory finding that he/she has a banned substance in his/her urine sample may, within three (3) calendar days following receipt of notice of said laboratory finding, present evidence of the inaccuracy of said finding to the Director of Athletics.  Sample “B” may be tested at the request of the student-athlete.  The test shall be performed by the laboratory who tested sample “A”. 

If the results of testing sample “B” find that the student-athlete does not have banned substances in his/her urine sample, the Director of Athletics must rely upon those test results and shall conclude that the student-athlete’s urine does not contain banned substances.

The student-athlete shall be responsible for paying the chosen laboratory if he/she elects to have his/her sample retested. The University shall reimburse the student-athlete for the expenses of such retesting in the event that the chosen laboratory determines that the student-athlete’s urine sample does not contain banned substances.

2. Appeal:

Student-athletes who believe they have been cited in error for violations of this policy (excluding failure to consent or withdrawal of consent) may appeal to the Director of Athletics stating in writing the reasons the athlete believes the decision was improper, or without merit or just cause. If necessary, a hearing may be held.

The Director of Financial Aid may attend all hearings held by the Drug Testing Appeals Committee, (if he/she is not already named to that committee) where the decision involves termination, downward gradation, or non-renewal of an athletic grant-in-aid.

Records Security:

The University has no purpose of invoking criminal justice procedures or Student Conduct Code disciplinary proceedings arising out of the use of ingestion of controlled substances or substances on the NCAA list of banned substances. The University, in conducting the testing program, is not acting in aid of or as an agent for state or federal law enforcement officials. Nor are those administering the tests acting as, for, or on behalf of University offices.

The test results would be deemed part of a student’s educational records protected from disclosure under state and federal law.  The test results do not become part of the student-athletes’ official education record, but are treated as if they are for privacy reasons as defined by the Buckley Amendment and Family Rights to Privacy Act.  However, these laws do not immunize student educational records from disclosure pursuant to a subpoena from a federal court or agency or a Delaware court or a Delaware agency with power to issue subpoenas.  In such an instance, the University will take reasonable steps to notify the record-subject may move the court or agency to quash any portion of the subpoena, which pertains to drug testing records.

The Division of Intercollegiate Athletics & Recreation Services experience with news media suggest that it is likely that sport reporters may draw inferences in the event of unexplained “disciplinary” suspension of student-athletes.  This inference is unavoidable.

Amendments:

This program may be amended from time to time at the discretion of the Director of Athletics.  Amendments shall be distributed to all student-athletes.  No amendment shall be applied retroactively if such application will adversely affect a student-athlete’s right to prior notice of standards of conduct or discipline.




Appendix A:    Consent Form

 

INFORMED CONSENT/RELEASE OF LIABILITY

 

I, __________________________________ (print name), a student-athlete at the University of Delaware , acknowledge that I have received a copy of the University of Delaware ’s Drug Testing Program policies and procedures.  I have read it, have been given the chance to ask questions about it, fully understand its provisions, and the consequences of positive testing(s).

I understand that drug use is a violation of team rules for all intercollegiate athletics at the University of Delaware and as such, I agree to abide by all the training rules established by the Athletic Governing Board.  Accordingly, I hereby consent to be tested in accordance with procedures adopted by the University of Delaware to determine if I have utilized a substance listed in the above-mentioned document.

I further understand that this consent and my test results will become a part of my educational records subject to disclosure only in accordance with my written Buckley Amendment Consent and Family Education Rights and Privacy Act of 1974.

I further understand that signing this consent form and agreeing to participate in the Drug Testing and Education Program is a mandatory prerequisite to my participation in intercollegiate athletics at the University of Delaware .

To the extent set forth in this document I hereby waive any privilege I may have in connection with the information that may be obtained as a result of my participation in the Drug Testing Program and Education Program.

I hereby release the University of Delaware and its Trustees, Officers, Employees and Agents from legal responsibility or liability for any action related to the implementation of the Drug Testing Program and Education Program or the release of information and records as authorized by the terms of the Program.

DRUG SCREENING PROTOCOL:

SPECIMEN COLLECTION AND WITNESS’ ROLE

PHASE I

 

1. Student-athlete reports at time announced for testing to the designated area and attendance is noted. (All exceptions to arrival at announced time, because of classes or work schedule, must have prior approval through the Director of Athletics or designated staff member.)

2. Student-athlete is advised to report with a full bladder and to indicate to employee noting attendance (site manager) of any time limits caused by academic commitment. Should a student-athlete have such a commitment, he/she may make arrangements, if approved, to sign out for that time block and return accordingly. (Football testing is unannounced – this first sentence doesn’t apply.)

3. The witness will accompany the student-athlete to the collection area. 

4. The student-athlete will then be asked to enter the testing room and select a sealed container of his/her choice, and to proceed to the collection area. The student-athlete will write his/her initials on the container at that time.  

5. The student-athlete can expect that at no time will the witness nor a tester have that container in their possession, nor will the student-athlete be out of sight of witness once the container has been selected up until end of Phase I. 

6. The witness then instructs the student-athlete to select a urinal or stall. The student-athlete proceeds to the urinal or stall to provide a sample. 

7. The witness says that they will no longer speak unless the donor requests it. Requests may also be made to have water faucets run or such as long as the witness never takes sight off of the process. Direct observation while voiding not required. 

8. As soon as collection is made, the student-athlete should cover the container with the lid. They may make use of the sink but need to keep container within their possession and witness’ view. Both witness and student-athlete proceed to testing room. The student-athlete and the sample are within view of the witness or a site manager, until the witness signs off in Phase I and student-athlete proceeds with testers on Phase II.

a. If the student-athlete is unable to give at all, the container can be disposed of in the testing room in a wastebasket for that purpose and the student-athlete asked to return to the designated area to wait. The student-athlete begins the entire procedure anew when the student-athlete deems readiness.

b. If the donor is unable to fill the container 2/3 full as necessary but wishes to keep the partial sample, then she or he must: 1) cover the container with the lid and now wait in the testing room under the view of either the witness or one of the site managers, 2) keep the container in their possession and they, themselves be out of arm’s reach of any other student-athlete, 3) he or she may request liquid but must stay in possession of partial sample in observed testing room, and 4) the student-athlete indicates to the site manager or witness upon readiness to complete collection and is then accompanied by the same witness who earlier began the process with that individual.

NOTE: At no time shall the witness nor tester have in his/her possession the container selected for collection.

9. If ever an empty cup is left standing, or a partially or fully filled cup not in close proximity and possession of its owner, a witness, a tester, or a site manager will dispose of the cup.

NOTE: Blue dye is added to the toilet bowl in female settings.

   

DRUG SCREENING PROTOCOL:

SPECIMEN HANDLING AND PRELIMINARY TESTING

PHASE II

 

1. The witness reports to processing/testing site with student-athlete (specimen in hand.)

2. The witness signs control sheet affirming witnessed donation and enters the student-athlete’s name on the certification form. 

3. Tester has selected two specimen containers marked “A” and “B”. 60 ml of the specimen must be poured into container marked “A”. 20 ml of the specimen must be poured into container “B”. A total of 80 ml must be provided as an acceptable specimen.

4. Lids of the numbered containers should then be tightly closed by the student-athlete. The tester places a bar code across the top of each lid of each container.

5. The tester tests the urine for specific gravity and pH and enters the results on the certification form.

6. If the specific gravity is less than 1.005 or the pH is alkaline, the collection process is begun again until an adequate specimen is obtained. Only satisfactory specimens should be submitted to the laboratory for analysis.

7. The student-athlete places the specimen containers in the specimen transport box and signs the certification form certifying that there were no irregularities in the entire collection, handling and testing process. The tester also signs certifying that he/she has followed the prescribed procedure and the site manager signs as well.

8. The specimen transport box will be sealed with the tape by a tester after the last specimen has been placed in the container. The container will then be under the observation of the tester at all times until it is passed to the courier or laboratory personnel.

9. After specimens have been received by the laboratory, the following policies are in effect:

a. The laboratory communicates with designated Athletic Program personnel when the screening indicates a positive result. Split samples are used and final confirmation of positive comes only from GC-MC method (gas chromatography – mass spectrometry). 

b. Specimens are held in the laboratory according to the following schedule:

1 week for negative test results

90 days for a positive test result

1 year for a positive test result when an offense is charged to the student-athlete
