General Information : Visas : Guidelines to Obtain H Visa Stamp

  • Depending on the embassy/consulate abroad, foreign nationals should anticipate up to one week's processing time for a visa.
  • It is the foreign national's responsibility to make any necessary appointments with the consular post for visa processing. Our office can provide the number and address of the post.
  • In order for the foreign national (and family members) to apply for an H visa, the following documents must be submitted to the closest U.S. embassy/consulate to their place of residence:

    1. Form OF-156 ("Nonimmigrant Visa Application") available at the consular post. The form should be signed and have a photo attached as indicated. Fees will vary depending on the country of residence.
    2. A passport sized photograph (37mm x 37mm) for each applicant.
    3. Original valid passport for each applicant.
    4. Original marriage certificate and proof of the dissolution of any prior marriages (and one additional copy), if applicable.
    5. Original birth certificate of children also relocating (and one additional copy).
    6. Form I-797 - approval notice from the USCIS granting employment authorization (this document will be provided by OFSS).
    7. Photocopy of the most recently approved Labor Condition Application (this document will be provided by OFSS).
    8. Photocopy of the most recently submitted I-129B (this document will be provided by OFSS).
    9. Letter from your department indicating that you are currently employed (dates and salary are necessary).
    10. It is also recommended that the foreign national carry proof of ties to their home country such as home or property ownership, bank accounts or other financial assets. These are supplemental documents and should be available in case the visa officer asks to examine them.

  • The visa can be applied for up to ten days prior to the effective date requested in the application to accommodate travel and relocation to the United States. However, the approval notice must also have been received within that time frame to allow filing of the application.
