The Hazardous Chemical Information Act and Your Right-to-Know
Instructions
to Supervisors
To
avoid receiving a Notice of Violation, you must respond directly to this notice
as follows:
complete
and return the documentation of training form, or;
submit
a statement that the employee/student will not handle hazardous materials or work
in an area where hazardous materials are used or stored, or;
if
the employee/student was previously trained, submit a copy of that training record.
All
Employees
The
State of Delaware Hazardous Chemical Information Act guarantees you access to
information regarding hazardous chemicals to which you may be exposed either during
your normal employment activities or during emergency situations. Your supervisor
will provide hazardous chemical training before you work with or in a work area
containing hazardous chemicals. There are a number of different options your supervisor
may use to provide this required training to you. They are listed below:
provide
a personal training session,
send
you to a session provided by the Department of Occupational Health & Safety
send
you to a session held by your department,
have
you read the Hazardous Materials Safety Manual and complete the Right-to-Know
quiz with them.
New
Faculty
The
Hazardous Chemical Information Act applies to students and the laboratory use
of hazardous chemicals. If your teaching or research activities involve hazardous
chemicals, you must provide your students, laboratory personnel, research assistants,
post-doctorate fellows, teaching assistants, etc., hazardous chemical training
before they work with or in a work area containing hazardous chemicals. Training
must be repeated annually, whenever the potential for exposure to hazardous chemicals
is altered, or whenever new information concerning a chemical is received. For
students, training is required at the beginning of each course. You must document
training sessions provided. For additional information or a listing of general

New
Supervisors
You
must provide, at least annually, an education and training program for employees
using or handling hazardous chemicals. Additional instruction is required whenever
the potential for exposure to hazardous chemicals is altered or whenever new information
concerning a chemical is received. New or newly assigned employees must be provided
training before working with or in a work area containing hazardous chemicals.
